A significant portion of our practice–both in size and in consideration–is our representation of not-for-profit businesses. [We try not to use the term “non-profit” because it’s a misnomer: you must make a profit, regardless of the type of business you have; it’s what you do with that profit that matters.]
More than fifty percent of not-for-profit businesses fail. This isn’t because their mission isn’t worthy; it’s because they are often set up to fail. A not-for-profit business must be a good business. Where a for-profit business succeeds when it gives return or profit to its shareholders, a not-for-profit business succeeds when it uses its donations wisely and well, creating a larger pool of funds and greater energy for its mission.
